association regarding your roof, pressure washing or siding,
chances are you next door neighbor got a similar letter.
We give discounts for doing houses in close proximity to
each other as "neighborhood discounts."
Mold/Mildew HOA Declarations Examples:
Example One:
Roofs: The following roof styles and materials shall not be permitted:
fiberglass panels; tin sheeting; any material that is other than earthtone, unless
approved by the MC. The minimum roof pitch generally required for each dwelling to be
constructed on a Unit shall be not less than five (5) feet of height for each twelve (12)
feet of extension, commonly known as “5:12 pitch”. Exceptions to these requirements
may be granted by the MC for designs found by them to be of exceptional merit.
Excessive mildew and mold build-up shall be removed.
Example Two:
Mold / Mildew Disclosure. Mold (mildew) is a common, naturally occurring
organism that grows indoors and outdoors. Mold may produce adverse health
effects although the scientific evidence is unclear as to the extent of health risk
or the amount of mold necessary to cause health impact. Modern building
codes, practices and materials provide living space that is energy efficient.
However, this energy efficiency is a result of minimizing air flow into or out of
the building. New buildings do not “breathe” like older buildings and are
therefore more susceptible to mold growth when the building air is not
conditioned, however, all buildings are susceptible to mold growth. Seller makes
no representation to Buyer concerning the presence or absence of mold or
mildew in the Unit at any time or in any quantity. Except to the extent
specifically covered by the Statutory Warranties, Buyer hereby expressly
releases Seller from any loss, claim, liability or damage now or hereafter arising
from or related to the presence at any time of mold or mildew in a Unit.
Example Three:
Mold: Mold, mildew, fungi bacteria and microbiologic organisms (collectively, “Molds”) are present in
soil, air and elsewhere in the environment. Molds can proliferate in various environments, including,
without limitation, damp areas such as crawl spaces, attics, bathrooms, within walls and partitions and
in basements. Certain parties have expressed concerns about the possible adverse effects on human
health from exposure to molds. Due to various reasons, including the varying sensitivities of different
individuals to various types of Molds, no state or federal standards regarding acceptable levels of
exposure to Molds currently exist. Purchaser is hereby advised to perform its own investigation
regarding the presence or potential presence of Molds within the Property and acknowledges that
Seller will not be responsible for damage caused by Molds. Additional information regarding mold
and mold testing may be obtained from the applicable county public health department. The crawl
space of the Residence shall be constructed in accordance with all existing ventilation standards
established by applicable code at the time the Residence is constructed. Purchaser acknowledges that
over watering of the Lot can create mold or sediment problems. Purchaser shall be solely responsible
for maintaining the Residence in a manner to prevent and/or reduce the proliferation of Molds in the
Residence.
